For businesses that process personal data, compliance with Türkiye’s Personal Data Protection Law (KVKK) involves more than placing a privacy notice on a website. The data inventory, purposes of processing, retention periods and security measures must be addressed together.

1. What data is processed?

First identify which personal data is collected from employees, customers, suppliers and visitors and through which channels. In addition to identity and contact details, special categories of personal data, such as health information, biometric records and criminal conviction data, may be subject to stricter rules.

2. Are the legal basis and purpose clear?

Each processing activity needs an identified legal basis. Explicit consent is not an automatic solution for every activity. Depending on the processing, other conditions may be relevant, including a legal requirement, the establishment or performance of a contract, compliance with a legal obligation and legitimate interests.

3. Are privacy notices and request procedures in place?

Individuals should be told who processes their data, for what purposes and on what legal basis, to whom the data may be transferred and how they can exercise their rights. An internal process is needed to receive, review and respond to requests within the applicable time limits.

4. How are retention and security managed?

  • Delete or anonymise data that is no longer needed.
  • Limit access permissions.
  • Inform staff of their obligations.
  • Review agreements with service providers.
  • Prepare a response plan for personal data breaches.
